Brookville man gets max sentence for 2nd domestic battery conviction

(BROOKVILLE, Ind.) – A Brookville man has received the maximum sentence following a second domestic battery conviction.
38-year-old Brandon Ashby was found guilty last month of battering and choking his girlfriend in June of 2024.
During the sentencing, Franklin County Deputy Prosecuting Attorney Blaine Timonera cited factors including the physical and emotional harm to the victim and said Ashby had a lack of remorse.
Franklin County Judge Alex Dudley then sentenced Ashby to the maximum penalty of 30 months in prison.
Prosecutor Chris Huerkamp is crediting the victim for her willingness to cooperate both during the investigation as well as at trial.
“She showed incredible fortitude throughout the entire process, from the time it was first reported to the police through the moment that Judge Dudley passed sentence,” said Huerkamp.
He also praised the Deputy Prosecutor Timonera for his handling of the case.
“This case presented some unique challenges in terms of preparation and presentation of the evidence. As I’ve come to expect, not only did Blaine rise to the occasion, he once again showed that it takes real experience to bring a case like this to justice,” Huerkamp said.
Prosecutors also commended the deputies who investigated the incident and testified at trial.
Huerkamp said this wasn’t the first time his office has prosecuted Ashby for a domestic violence-related incident.
In 2022, Ashby was found guilty of domestic battery that involved a different victim. He was sentenced to the maximum term of 30 months following that trial as well.
